As much as I believe in my heart of hearts that resolving divorces through the Collaborative Process is the best way to have an outcome that is good for all concerned, that does not mean it doesn’t have its pitfalls. Many of the potential drawbacks go directly back to the attorneys and clients initial expectations and some subtleties during the process. If the case breaks down, it has less to do with the Collaborative Process than the dynamics during the process. Attached is a great article that is a great road-map to follow insuring a smoother path down the Collaborative trail. There are great points for attorneys and couples to understand how they can help to avoid stumbling blocks that can occur. Much of it has to do with attorneys educating their clients not only before but during the process. Couples need to take responsibility for some of the actions and behavior they may be conveying. Attorneys need to remember that this is their clients divorce and allow them to create and choose the options that will ultimately result in the best outcome for all.
