This week was a very interesting one with conflicts on multiple fronts in a few of my cases. It was truly telling on why the Collaborative Process is the better option for divorce resolution. One case had wife filing a Domestic Violence Injunction against my client and another had wife going to marital business and opposing counsel’s office. Both were truly instigated by the inability of the system to move their cases along and the high conflict of the case. Neither situation would have happened had they been handled collaboratively.
Attached is an amazing article published in the Huffington Post truly explaining how Collaborative Divorce works and how much different in a positive way from traditional litigation. It describes how Collaborative divorce is successful due to the non-adversarial nature of the process and how the couple work together toward a mutual resolution to the issues instead of hashing it out in court with the Judge ultimately deciding the outcome. This is one of the better articles that really captures the essence of the Collaborative process sand how its a win-win for everyone involved including the children. Its important to note that even when there are no children involved, the Collaborative process works superbly. When you resort to going to court to settle your divorce, it feels like the same old story, same old act. It’s one step up and two steps back. When you decide your divorce, it’s not the same thing night on night. It’s not Who’s wrong or who’s right.
